Hi all, me again.
Just been refused a day off in leiu for being On Call during Easter Monday!!!!!, even though i've already had a day off for being O/C on Good Friday. This has always been the case with O/C during Bank Holidays at our Trust, at least since i started. I'm sure we are still under Whitley but i have been told that there is a query over definitions and that i will have to cover my days fishing tommorrow with A.L. until the matter is resolved. I have of course pointed out that i was contacted at home and asked to cover the whole Easter break O/C and it was stated then that i will be rewarded 2 days TOIL for the PH's but now this!!!
HELPPPP!!!
Now, where did i put that goodwill?

What was said/written doesnt always happen sadly..

Im fighting my right for my pay increase.. job advert said 6months..HR now saying 12 months..

Hope you get your days back/time back ! lovley time to go fishing

What a pain TOIL & On Call can be, this is we get around it:

TOIL - All TOIL is agreed by both parties & in writing before the individual goes anywhere. This has saved any "He said this & he said that" going on in the department.

On Call - You are either on call or not, if you are called in then you get a full day TOIL, if you are not called in then you get the day as a free holiday and you dont have to use any holiday days up.

These simple procedures have saved alot hassle - might not work for all but it works for me.

I would define "called in" as - you are at home with your feet up and the phone / mobile rings and you have to go to work, however have a look at this called in - I did find this funny.

Never heard of any cases of someone being called in by "a friend" (just to qualify for the day off, or whatever), then? By Jove, you must have a brilliant set of guys! Lucky you. \:\)

We are only permitted 1 lieu day for a bank holiday period.
therefore goood friday : easter monday if you cover the whole period you only get one day back.
we solved it by splitting the bank holidays between us.
one tech does friday & saturday.
the other sunday & monday.

We get a day in lieu per day on call, whether we are called in or not. After all, even if you are not called in, you still can't do what you want to do all day. Additionally, we get a nominal sum of money if we are not called in, and time and a half if we are. Also, on-call is voluntary - there is no shortage of volunteers because people see that they are getting the lieu day plus the original day off, albeit with restricted freedom.

What you have Panander, we have always had, that is until today.
Also since my last post another colleague of mine has informed me that he too was O/C over Easter and was granted his 2 days TOIL recently authorized by the same manager who has put mine on hold. I have pointed this out to my manager who said he didn't know then what they know now!
Must be my fault!

The words "Custom and Practice" should be used me thinks to your manager Mr Topper.
Were you on call from 8am till 5pm (or whatever your core hours are) on the BH.
Would you normally be on call during these hours on a Monday.
This is extra to what is normally an out of hours On Call I would presume.
You should be entitled to the equivalent period in time in T.O.I.L.
I presume you work for the NHS
If so the NHS has agreed to abide by the European Working Time Directive.
This is why we now have standard things as part of AfC
The words "Simap" decision and "Jaeger" decision are based around cases on time workings that have been won and the precedent set in European Law.
Seek advice my friend and speak from a point of knowledge.

p.s. Are you sure your boss just doesn't like you !
