As we do not do on-call, I do not want to vote so I do not skew the figures, but I am interested in viewing the results. There is a button there fore that reason but I am not allowed to use it without voting. Why not?

Robert for your info when i voted, just now, the result was approx 2/3 were getting lieu days.

Can someone please explain to me how you have got these lieu days.

I am on call christmas day and have been told I will not.
My husband is a medical engineer in another trust and neither is he etting lieu day f0r 26th dec.
(yeh , I know not many medical engineers are married to other medical engineers).


I am very jealous of you lucky engineers who are and would very much appreciate any help.

Hope this link helps,basically if by being on-call you are restricted in any way i.e. can't have an alcoholic drink or need to stay within range of the hospital then you are entitled to lieu time.

Tracy we were told at first we would not get the lieu days for Saturday & Sunday and the following Saturday. But after badgering payroll and dept. manager we got an answer that said we would get the lieu days for the weekends and the days following. 2 Mondays and Tuesday. Took a bit of time to get there though.

Would you normally get lieu days for being on-call on a normal Saturday and Sunday?

We get one lieu day for each "working day" period on a bank holiday, in other words one for the Mon 27th and one for Tues 28th.

We have actually got a grievance going with the Trust at the moment over EWTD and rest periods as part of on-call.

We're told by the union if we are successful it may have monumentous bearing on how Trust's implement EWTD as part of on-call, SiMAP and Jaeger for those informed, as to law.

I shall keep you all informed.

p.s. Tracy, you're not on your own as to "marrying" into the med eng community, the hours of fun we have talking about defibs, monitors, vents..... snore!!

The only problem is the copy of the whitley rules are in personel and look so old i would be surprised if mobile phones existed when they were wrote,(the salary quoted was amusing). Are they on the web anywhere?

I not sure if whitley rules apply as we are now on new contracts (even though i have not been matched or seen a new contract), as new holiday allowances are in force (AGC conditions).

My understanding of lieu days is to compensate for working bank holidays.
Therefore i will get a lieu day for mon 27th dec, but not one for sat 25th dec.

Dave, its very interesting to hear comments on EWTD, didn't you post before regarding rest periods for being called out during the night? All the years I've been on call I've never known a manager agree to this but im sure I've told one when to expect me as I've havent slept (as is my way).

My interpretation of AfC is that you will be given equivalent periods of compensatory rest for work done on a Bank Holiday.

If you are on call for 24 hours then 24 hours of compensatory rest (time in lieu) are due. Or the period split between individuals accordingly. (Section 5.14 of the Final Arrangement AfC Nov 04)

Because of the extra days annual leave I don't think compensatory rest would apply to situations that we have this festive period with Xmas Day and Boxing Day falling on a Sat/Sun. These would be covered as would a normal rota that was in place.

Tracy, you are quite right, I have posted elsewhere regarding on-call.
I have e-mailed several people over our "local agreement" to do with consecutive rest periods and compensatory rest.

I suppose we have forced the issue here with our HR Dept by asking for clarification of the EWTD with specific reference to out-of-hours service provision.

We are at an advanced stage and the outcome could be widespread and may set a precedent.

I can't say too much but we belive our case is strong, based in law, and we have the full backing of Unison.

It may get to an Employment Tribunal stage where a judicial ruling may take place.

Unless "special cases" rulings are applied everyone is entitled in a 7 day period of 6 x 11 hour consecutive uniterrupted breaks from work and one period of 24 hours of consecutive uninterrupted rest. If that is not possible then two periods of 35 hours (24 + 11 hours) within the next 7 days.

Dispute surrounds wether on-call constitutes "rest" and wether call outs generated result in compensatory rest or consecutive rest.

Watch this space, all will be revealed
